Please read these Terms and Conditions carefully before using the SecondMind app. By downloading or using the app, you agree to be bound by these terms.
1. Acceptance of Terms
By accessing or using SecondMind (the "Service"), operated by Saurabh Infosys ("Company", "we", "us", or "our"), you agree to be bound by these Terms and Conditions ("Terms"). If you do not agree to these Terms, do not use the Service.
2. Eligibility
You must be at least 13 years of age (16 in the European Economic Area) to use SecondMind. By using the Service, you represent and warrant that you meet this age requirement.
3. Account Registration
To use certain features, you must create an account. You agree to provide accurate, current, and complete information. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. Notify us immediately at [email protected] if you suspect unauthorized access.
4. Subscription and Payment
Free Tier: SecondMind offers a free tier with a limit of 30–50 items. After reaching the limit, you may view and search but not add or edit items without upgrading.
Paid Subscriptions: Pro plans are billed monthly or annually. Pricing is displayed in the app and may vary by region. All payments are processed through the App Store (Apple) or Google Play (Google) and are subject to their respective payment terms.
Auto-Renewal: Subscriptions auto-renew unless cancelled at least 24 hours before the current period ends. You can manage or cancel subscriptions through your store account settings.
Refunds: Refund requests are handled by Apple or Google under their respective policies. We do not issue refunds directly.
Lifetime Access: Lifetime purchases are one-time payments granting permanent access to Pro features as they exist at the time of purchase. Future features may require additional payment.
After Expiry: If your subscription lapses, your account moves to view-only mode. Your data is never deleted due to a lapsed subscription.
5. Acceptable Use
You agree not to:
- Use the Service for any unlawful purpose
- Attempt to gain unauthorized access to any part of the Service
- Reverse engineer, decompile, or disassemble the app
- Upload malicious code or interfere with the Service's infrastructure
- Use the Service to track items belonging to others without their consent
- Resell or commercially exploit the Service without written permission
6. Intellectual Property
All content, features, and functionality of SecondMind — including but not limited to software, design, text, graphics, logos, and trademarks — are owned by Saurabh Infosys and are protected by applicable intellectual property laws. Your personal data (item names, notes, etc.) remains yours.
7. User Content
You retain ownership of all content you enter into the app (item names, locations, notes). By using the Service, you grant us a limited license to store and process this content solely to provide the Service to you. We do not use your item content for analytics, advertising, or any purpose other than delivering the app's functionality to you.
8. Disclaimers
SecondMind is provided on an "AS IS" and "AS AVAILABLE" basis. We make no warranties, express or implied, including but not limited to merchantability, fitness for a particular purpose, or non-infringement. We do not guarantee that the Service will be uninterrupted, error-free, or completely secure.
SecondMind is a memory aid tool and does not replace physical inventory systems, legal record-keeping, or professional item management services.
9. Limitation of Liability
To the maximum extent permitted by law, Saurabh Infosys shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of data, loss of profits, or any other damages arising from your use of or inability to use the Service — even if we have been advised of the possibility of such damages.
Our total liability to you for any claims arising from these Terms or your use of the Service shall not exceed the amount you paid us in the 12 months preceding the claim.
10. Termination
We reserve the right to suspend or terminate your account at any time for violations of these Terms, with or without notice. You may terminate your account at any time through the app settings. Upon termination, your right to use the Service ceases immediately.
11. Governing Law
These Terms are governed by the laws of India. Any disputes shall be subject to the exclusive jurisdiction of courts in India.
12. Changes to Terms
We may update these Terms from time to time. We will provide notice of significant changes through the app or by email. Continued use of the Service after such changes constitutes your acceptance of the new Terms.
